1. Introduction and Acceptance
Welcome to HashForge ("Platform," "we," "us," or "our"), a hashrate rental service operated in the United States. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HashForge governing your access to and use of our hashrate rental platform, including all associated services, features, and content.
By creating an account, accessing, or using HashForge, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification at least fourteen (14) days before taking effect. Your continued use of HashForge after such modifications constitutes acceptance of the updated Terms.
2. Eligibility and Account Registration
2.1 Eligibility Requirements
To use HashForge, you must:
- Be at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater;
- Have the legal capacity to enter into binding contracts;
- Not be a resident of, or located in, any jurisdiction where cryptocurrency mining or hashrate trading is prohibited;
- Not be subject to economic sanctions or listed on any U.S. Government prohibited or restricted parties list, including the Office of Foreign Assets Control (OFAC) Specially Designated Nationals list;
- Comply with all applicable local, state, federal, and international laws and regulations.
2.2 Account Creation
To access HashForge services, you must register for an account by providing accurate, current, and complete information, including a valid email address and BCH2 payout address. You agree to:
- Maintain and promptly update your account information to keep it accurate and complete;
- Maintain the security and confidentiality of your login credentials and API keys;
- Immediately notify us of any unauthorized access to or use of your account;
- Accept full responsibility for all activities that occur under your account.
You may not create multiple accounts, share your account credentials, or transfer your account to another party without our prior written consent.
2.3 Two-Factor Authentication
We strongly encourage the use of two-factor authentication (2FA) to enhance account security. Two-factor authentication is required for withdrawal operations. You acknowledge that failure to enable 2FA may increase your account's vulnerability to unauthorized access, and we shall not be liable for any losses resulting from your failure to implement available security measures.
3. Description of Services
3.1 Hashrate Rental
HashForge provides a platform for users to rent SHA-256 mining hashrate directed toward the BCH2 (Bitcoin Cash II) network via Forge Pool. When you place an order:
- You are renting computational power, not purchasing or acquiring ownership of any mining hardware;
- Hashrate is delivered through the Braiins Hashpower marketplace infrastructure;
- Mining rewards are distributed according to your selected mining mode (PPLNS or Solo) and directed to your registered BCH2 address;
- Your budget is consumed based on actual hashrate delivery at prevailing market rates.
3.2 Mining Modes
PPLNS (Pay Per Last N Shares): You receive proportional mining rewards based on your contributed shares. This mode provides more consistent, predictable payouts.
Solo Mining: You receive the full block reward if your rented hashrate finds a block. This mode carries higher variance—you may receive nothing or significantly more than expected.
3.3 No Guarantee of Profits
HASHFORGE DOES NOT GUARANTEE ANY MINING PROFITS, RETURNS, OR SPECIFIC OUTCOMES. Cryptocurrency mining is inherently speculative and subject to numerous factors beyond our control, including but not limited to:
- Network difficulty adjustments;
- Cryptocurrency price fluctuations;
- Block reward halvings or changes;
- Network congestion and transaction fees;
- Mining luck variance (especially for solo mining).
You acknowledge and accept these risks and agree that we bear no liability for mining outcomes.
4. Orders, Payments, and Refunds
4.1 Placing Orders
When placing a hashrate rental order, you must specify:
- Mining mode (PPLNS or Solo);
- Desired hashrate in petahashes per second (PH/s);
- Budget in Bitcoin (BTC).
Orders require a minimum budget sufficient to cover at least one (1) hour of mining at your selected hashrate. By confirming an order, you authorize us to deduct the specified budget from your account balance.
4.2 Order Confirmation and 60-Minute Lock Period
Once an order is placed and mining begins, it cannot be cancelled for a minimum of sixty (60) minutes. This lock period exists because:
- Hashrate is immediately allocated on third-party marketplace infrastructure;
- Mining operations cannot be instantly reversed;
- Early cancellation would disrupt marketplace operations and pricing.
By placing an order, you explicitly acknowledge and consent to this 60-minute minimum commitment.
4.3 Payments and Deposits
HashForge accepts Bitcoin (BTC) as the sole payment method. When depositing funds:
- Send BTC only to your designated deposit address;
- Deposits require a minimum of three (3) blockchain confirmations before crediting;
- Network transaction fees are your responsibility;
- Sending non-BTC assets or incorrect amounts may result in permanent loss of funds.
4.4 Cancellations and Refunds
After the 60-minute lock period, you may cancel an active order at any time. Upon cancellation:
- Any remaining, unspent budget will be credited back to your account balance;
- Refunds are calculated based on actual hashrate consumed at market rates;
- Processing may take up to 24 hours to reflect in your balance.
Refunds are not available for:
- Completed orders where the full budget was consumed;
- Orders terminated due to violation of these Terms;
- Mining outcomes that did not meet your expectations.
4.5 Withdrawals
You may withdraw your available account balance at any time, subject to:
- Minimum withdrawal amount requirements;
- Network transaction fee deductions;
- Two-factor authentication verification;
- Any applicable legal holds or compliance requirements.
Withdrawal requests are typically processed within 24-48 hours but may take longer during periods of high volume or if additional verification is required.
5. Know Your Customer (KYC) and Anti-Money Laundering (AML)
5.1 Compliance Requirements
HashForge is committed to compliance with applicable U.S. anti-money laundering laws and regulations, including the Bank Secrecy Act (BSA) and related FinCEN guidance. We may, at our sole discretion, require identity verification for:
- High-value transactions or deposits;
- Suspicious activity patterns;
- Withdrawal requests above certain thresholds;
- Compliance with legal or regulatory requirements.
5.2 Information Requests
When verification is required, you must provide accurate, truthful, and complete information, which may include:
- Government-issued photo identification;
- Proof of residence;
- Source of funds documentation;
- Additional information as reasonably requested.
5.3 Account Restrictions
Failure to comply with verification requests may result in:
- Temporary or permanent account suspension;
- Restriction of deposit, withdrawal, or trading capabilities;
- Freezing of account funds pending resolution.
Funds remaining frozen due to non-compliance for a period exceeding one (1) year may be deemed abandoned and forfeited in accordance with applicable law.
6. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws, regulations, or third-party rights;
- Providing false, misleading, or fraudulent information;
- Using the Platform for money laundering, terrorist financing, or other illicit purposes;
- Attempting to manipulate, exploit, or abuse Platform systems or pricing;
- Interfering with or disrupting Platform operations or security;
- Circumventing any security measures, access controls, or usage limits;
- Using automated scripts, bots, or scrapers without authorization;
- Engaging in market manipulation or fraudulent trading practices;
- Creating multiple accounts to circumvent restrictions;
- Assisting or enabling others to engage in prohibited activities.
7. Intellectual Property
All content, features, and functionality of HashForge—including but not limited to text, graphics, logos, icons, images, software, and underlying code—are the exclusive property of HashForge or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use HashForge solely for its intended purposes in accordance with these Terms. This license does not include:
- Modification, copying, or distribution of Platform content;
- Commercial use beyond authorized hashrate rental;
- Reverse engineering, decompiling, or disassembling any software;
- Removal of any proprietary notices or labels.
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using HashForge, you consent to the collection and use of information as described in our Privacy Policy.
We implement industry-standard security measures to protect your data, including encryption, secure servers, and access controls. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
9. Disclaimers and Limitation of Liability
9.1 "As Is" Provision
HASHFORGE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties regarding accuracy, reliability, or completeness of content;
- Warranties that the Platform will be uninterrupted, secure, or error-free;
- Warranties regarding mining profitability or investment returns.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HASHFORGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or anticipated savings;
- Loss of data or cryptocurrency assets;
- Loss of goodwill or reputation;
- Cost of substitute services;
- Any damages arising from unauthorized access to your account;
- Any damages arising from third-party conduct or content.
In no event shall our total aggregate liability exceed the greater of (a) the total fees paid by you to HashForge in the three (3) months preceding the claim, or (b) one hundred U.S. dollars ($100).
9.3 Third-Party Services
HashForge integrates with third-party services, including the Braiins Hashpower marketplace. We are not responsible for the availability, accuracy, or reliability of third-party services, and we disclaim all liability for any losses arising from third-party service failures or changes.
10. Indemnification
You agree to indemnify, defend, and hold harmless HashForge and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to HashForge;
- Your violation of these Terms;
- Your violation of any applicable law or third-party rights;
- Any content or information you submit through the Platform;
- Any dispute between you and a third party.
11. Force Majeure
HashForge shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or extreme weather events;
- War, terrorism, civil unrest, or armed conflict;
- Government actions, embargoes, or sanctions;
- Epidemics, pandemics, or public health emergencies;
- Cyberattacks, network failures, or infrastructure outages;
- Cryptocurrency network attacks, forks, or protocol changes;
- Third-party service provider failures;
- Power outages or telecommunications failures;
- Labor disputes or strikes.
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting support. Upon termination:
- All active orders will be cancelled (subject to the 60-minute lock period);
- Remaining account balance may be withdrawn subject to verification;
- Your access to the Platform will be revoked.
12.2 Termination by HashForge
We reserve the right to suspend or terminate your account immediately, without prior notice, for any reason, including but not limited to:
- Violation of these Terms or any applicable law;
- Suspected fraudulent, abusive, or illegal activity;
- Failure to comply with verification requirements;
- Extended account inactivity;
- Request by law enforcement or government authority;
- Platform discontinuation or material service changes.
In cases of termination for cause, we may forfeit any remaining account balance and pursue additional legal remedies.
12.3 Effect of Termination
Upon termination, the following provisions shall survive: Sections 7 (Intellectual Property), 8 (Privacy), 9 (Disclaimers and Limitation of Liability), 10 (Indemnification), 13 (Dispute Resolution), and 14 (General Provisions).
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.
13.2 Binding Arbitration
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF HASHFORGE SHALL BE RESOLVED BY BINDING ARBITRATION administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted:
- By a single arbitrator mutually agreed upon by the parties;
- In the English language;
- In the State of Texas, or remotely via videoconference if mutually agreed;
- In accordance with Texas law.
The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against HashForge.
13.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or prevent irreparable harm.
14. General Provisions
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
14.2 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and HashForge regarding the subject matter hereof and supersede all prior or contemporaneous communications and proposals.
14.3 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
14.4 Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision shall not constitute a waiver of such right or provision.
14.5 Assignment
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction.
